e.g if a user calls joinTransaction when using a local transaction, what should happen? currently just proceeds and the JPA spec says nothing. Would be better to throw an IllegalStateException for consistency.

e.g what if a user has a JEE EM and consequently is using JTA. The current check is on the local transaction being active.

SVN trunk caters for some situations now. test.jpa.general and test.jpa.jta pass as before so JSE usage is fine
